1. Agreement
These Terms of Use are an agreement between you and Noah Technology, Inc. ("Luna," "we," "us," or "our"). By downloading, accessing, or using Luna, you agree to these terms and our Privacy Policy. If you do not agree, do not use Luna.
2. What Luna is
Luna is an AI voice companion designed for everyday conversation, reflection, and preserving personal stories. Luna is technology, not a human being. Responses are generated by artificial intelligence and may occasionally be inaccurate, incomplete, or inappropriate.
3. Not medical or emergency care
Luna does not provide medical, mental-health, legal, financial, or other professional advice and is not a substitute for professional care. Do not rely on Luna for diagnosis, treatment, emergency assistance, or safety-critical decisions. In an emergency, contact local emergency services or a trusted person immediately.
4. Eligibility and acceptable use
You must be at least 13 years old to use Luna. You agree not to:
- Use Luna unlawfully or to harm, threaten, exploit, or impersonate anyone.
- Attempt to bypass security, probe the service, or access another person's information.
- Reverse engineer, resell, copy, or misuse Luna except where law expressly permits it.
- Upload or share content you do not have the right to use.
5. Your stories
You retain ownership of the recordings, transcripts, photos, and other content you create. You give us a limited right to process that content only as needed to provide, secure, and improve the requested Luna feature. You are responsible for deciding what to save and share and for having permission to share information about other people.
6. Subscriptions and free trials
Luna may offer monthly and annual auto-renewable subscriptions through Apple. Available prices and trial terms are shown before purchase. Payment is charged to your Apple Account. Unless canceled at least 24 hours before the end of the current period, a subscription renews automatically and Apple charges the renewal price within 24 hours of renewal. Manage or cancel your subscription in your Apple Account settings. Apple handles billing and refunds under its policies.
7. Service changes and availability
We may add, change, suspend, or discontinue features. Luna requires a compatible device, microphone access, and an internet connection for voice conversations. We do not promise uninterrupted or error-free service.
8. Intellectual property
Luna's software, design, name, artwork, and related materials belong to us or our licensors. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Luna for its intended purpose.
9. Disclaimers and limitation of liability
To the fullest extent permitted by law, Luna is provided "as is" and "as available" without warranties of any kind. Noah Technology, Inc. and its officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or opportunity arising from Luna. Our total liability will not exceed the greater of the amount you paid for Luna during the 12 months before the claim or US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Termination
You may stop using Luna at any time. We may suspend or terminate access if you materially violate these terms, create risk for others, or use the service unlawfully. Provisions that by their nature should survive termination will remain in effect.
11. Governing law and changes
These terms are governed by California law, excluding its conflict-of-law rules. Courts located in San Francisco County, California will have exclusive jurisdiction unless applicable consumer law requires otherwise. We may update these terms and will post the effective date above. Continued use after an update means you accept the revised terms.
